These Terms of Service (“Terms”) govern your access to and use of the LunaBaby mobile application, website, and related services (collectively, the “Service”).
By accessing or using LunaBaby, you agree to be bound by these Terms. If you do not agree, do not use the Service.
LunaBaby is a baby tracking and family support app that helps users record and manage baby-related information such as sleep, feeding, diapers, notes, schedules, routines, reminders, and caregiver sharing.

You may use the Service only if:
you are legally capable of entering into a binding agreement; and
you are authorized to create an account and provide information for yourself and any child or dependent whose data you enter into the Service.
If you use LunaBaby on behalf of a child, family member, or household, you represent that you have authority to do so.
To use certain features, you may need to create an account. You agree to:
provide accurate, current, and complete information;
keep your account information updated;
maintain the confidentiality of your login credentials and email account;
promptly notify us of any unauthorized use of your account.
You are responsible for all activities that occur under your account, whether or not you authorized them, unless prohibited by law.
LunaBaby may require email verification codes, password reset codes, or similar account-security steps. You agree not to:
misuse or circumvent authentication flows;
use another person’s verification code;
access accounts or caregiver sessions you are not authorized to use.
We may suspend or limit access if we detect suspicious, abusive, or unauthorized activity.
LunaBaby may allow an account owner to invite a caregiver using a caregiver access code or similar method.
By using caregiver access:
the account owner is responsible for deciding whom to invite;
the caregiver is granted only the level of access provided by the Service, which may be read-only;
the owner is responsible for revoking access when appropriate;
LunaBaby does not verify the identity, trustworthiness, or legal authority of invited caregivers beyond the app’s technical access controls.
You understand that granting caregiver access may allow another user to view baby-related information that you choose to share through the Service.
You agree not to:
use the Service for any unlawful, harmful, fraudulent, or misleading purpose;
upload or submit false, abusive, defamatory, infringing, or obscene content;
interfere with, disrupt, or compromise the Service or its security;
attempt to access accounts, data, or systems without authorization;
reverse engineer, scrape, copy, or exploit the Service except as allowed by law;
use the Service in a way that could harm LunaBaby, other users, or children whose information is stored in the app.
We may investigate and take appropriate action for violations, including suspension or termination.
You retain ownership of the information and content you submit to LunaBaby, subject to the rights necessary for us to operate the Service.
By submitting content, you grant LunaBaby a limited, non-exclusive, worldwide, revocable license to host, store, process, display, reproduce, and transmit that content solely for the purpose of operating, improving, securing, and supporting the Service.
You are solely responsible for:
the accuracy of the content you submit;
ensuring you have the right to submit it;
the consequences of sharing it with caregivers or others through the Service.
Certain features may require a paid subscription or in-app purchase.
If you purchase a subscription:
billing is processed by Apple App Store or Google Play, not by LunaBaby directly;
pricing, renewal, billing dates, and cancellation settings are governed by the applicable app store;
subscriptions may renew automatically unless canceled through your app store account;
you are responsible for reviewing the subscription terms shown before purchase.
We may change subscription features, pricing, or availability to the extent permitted by law and the applicable app store rules.
If premium access is provided through a test account, promotional access, or review access, that access may be limited, revoked, or changed at any time.
The Service, including its software, design, branding, user interface, text, graphics, code, logos, features, and all related intellectual property, is owned by LunaBaby or its licensors and is protected by applicable intellectual property and unfair competition laws.
These Terms do not grant you any ownership rights in LunaBaby or the Service. Except for the limited right to use the Service in accordance with these Terms, all rights are reserved.
You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works from the Service except as expressly permitted in writing.
We may modify, improve, suspend, or discontinue any part of the Service at any time, with or without notice, including features, functionality, integrations, or subscription offerings.
We do not guarantee that the Service will always be available, uninterrupted, error-free, or compatible with every device or environment.
LunaBaby is provided for informational, organizational, and personal tracking purposes only.
LunaBaby does not provide medical advice, diagnosis, treatment, emergency services, or clinical monitoring. The Service is not a medical device and is not a substitute for a licensed physician, pediatrician, nurse, emergency provider, or other qualified healthcare professional.
Always seek professional medical advice for health-related questions concerning a child. Never disregard professional medical advice or delay seeking it because of information stored in or displayed by the Service.
If you believe a child may be experiencing a medical emergency, contact emergency services immediately.
To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis.
LunaBaby disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing or usage of trade.
We do not warrant that:
the Service will be uninterrupted, secure, or error-free;
data will never be lost, delayed, or corrupted;
the Service will meet all of your expectations or requirements;
caregiver sharing, notifications, reminders, or sync features will always operate without interruption or delay.
To the fullest extent permitted by law, LunaBaby and its affiliates, founders, officers, employees, contractors, licensors, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, goodwill, data, business opportunity, or other intangible losses, arising out of or related to:
your use of or inability to use the Service;
data loss, corruption, or unauthorized access;
caregiver access, sharing decisions, or third-party misuse of shared information;
subscription issues handled through app stores;
service interruptions, bugs, crashes, or security incidents.
To the fullest extent permitted by law, LunaBaby’s total cumulative liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of:
the amount you paid to LunaBaby through the Service in the 12 months before the claim arose; or
fifty U.S. dollars (US $50).
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
You agree to defend, indemnify, and hold harmless LunaBaby and its affiliates, personnel, licensors, and service providers from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to:
your use of the Service;
your content;
your violation of these Terms;
your violation of applicable law;
your misuse of caregiver access or sharing features.
We may suspend, restrict, or terminate your access to the Service at any time, with or without notice, if we reasonably believe:
you violated these Terms;
your use presents legal, security, or operational risk;
continued access could harm LunaBaby, other users, or third parties;
we are required to do so by law.
You may stop using the Service at any time. Deleting the app does not automatically delete your account or stored data.
Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitation of liability, indemnity, governing law, and dispute-related provisions.
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction and venue of those courts.
We may update these Terms from time to time. If we make material changes, we may provide notice through the Service, by email, on our website, or by another reasonable method.
Your continued use of the Service after the updated Terms become effective constitutes your acceptance of the revised Terms.
